What is a works council

The works council is the employee representative body for all tariff and non-tariff employees (AT) and represents their interests vis-à-vis the employer.

Why does a new works council have to be elected?

Due to the de-consolidation of Fresenius Medical Care, a new employee representative body must be elected for the Bad Homburg site. The transitional mandate of the current Works Council expires on May 31, 2024. In order to prevent a period without a works council, the election must have been held by then.

How long is the parliamentary term?

In our particular case, the election period is 2 years. We have to hold this election outside the regular election period due to the de-consolidation of Fresenius Medical Care. The next works council election will take place regularly between March 1 and May 31, 2026. The term of office is then four years.

Why should I vote?

You can only appoint the works council representatives you want by casting your vote. Only if you use your voice will you have an influence on who represents your interests and stands up for you.

Am I entitled to vote in the works council election?

You are only entitled to vote if you have been entered on the electoral roll. The list of voters is available at the locations. If your name is missing, please contact the election committee. In principle, you must be 16 years of age or older and be employed by Fresenius Medical Care. Temporary workers are also entitled to vote if they are expected to be employed by the company for longer than three months.

Which locations need to elect a new works council?

Only the Bad Homburg site has to elect a new works council. All other Fresenius Medical Care sites, such as Schweinfurt and St. Wendel, already have their own works council. The area covered by the new employee representative body in Bad Homburg includes the EK1, EK3, D15, S21, S22, S24 (production site in Ober-Erlenbach) and the logistics center in Biebesheim.

How is the works council election conducted?

There will probably be a list election again this time. It is not possible to vote for individual candidates from these lists, but only for a complete list. So you have to choose one of the lists and can “only” do it by selecting a list with 1 cross.

Can I vote by post or do I have to be on site to vote?

You are not on site for the works council election? No problem! Please contact the election committee and request a postal vote for yourself by e-mail. You will then conveniently receive the postal voting documents at home. Once you have decided on a list, please return the prepaid envelope by post. To ensure that your vote is really valid, please follow the precise instructions that you will receive with your voting documents.
Alternatively, you can also go directly to the polling booth at your location and cast your vote.

Can’t I just cast my vote electronically in this day and age?

No! Votes cast electronically are not permitted. The works council elections must be conducted in accordance with the Works Constitution Act and the election regulations. And this German law does not provide for electronic voting.

When will the election take place?

The works council elections will take place from April 22 – 25, 2024. Please check the Blue Space intranet or the election notice board for information on exactly where and when you can cast your vote.

Vote count – Is the counting of all votes public? Can I be there?

Yes! After the polling stations close on April 25, 2024, all votes will be counted publicly. You can be part of it. You can find out exactly where and when the count will take place on the election board’s notice board.

When and where can I see the election results?

The result of the works council election will be announced after the votes have been counted. If there have been errors in the conduct of the election, the election result can be contested within a two-week period. Once this deadline has passed, the election result is final. You will also be able to read the election results here on our website under “News”, as we will be publishing them.

When will I know who has taken over which functions in the new works council?

During the constituent meeting of the new works council, individual functions, such as the works council chair and a deputy, are elected and communicated first to the employer and then to all colleagues. This meeting will probably take place in May 2024. We will publish an article here on this website in due course under our “News” menu item and keep you informed.
